OSHA Extends Delayed Enforcement of Post-Incident Drug Testing Rule

The U.S. Occupational Safety and Health Administration (OSHA) has extended the delay of enforcement of the controversial "anti-retaliation" provisions within the injury and illness reporting rule until December 1, 2016.  The provisions became effective on August 10, 2016, and OSHA previously delayed enforcement until November 1, 2016.  According to OSHA's memo to regional administrators, the original delay was "to allow time for additional outreach to the regulated community."  OSHA issued this extended delay at the request of a federal court--in the case of TEXO ABC/AGC Inc. v. Perez, No. 3:16-cv-01998-D (N.D. Tex.)--currently considering a motion challenging the anti-retaliation provisions.
