Eleventh Circuit to Review Clean Water Act Permits for Transmission Pipeline Projects

Conservation groups have recently requested that the United States Court of Appeals, Eleventh Circuit expedite a review of several Clean Water Act Section 404 permits issued by the U.S. Army Corps of Engineers.  The permits are necessary under the Clean Water Act to allow these natural gas transmission companies to construct transmission pipelines in Alabama, Florida, and Georgia through wetlands.  The conservation groups are seek expedited review under certain provisions of the federal Natural Gas Act found at 15 U.S.C. § 717r.
