PPGMR Law Successfully Obtains Dismissal For Client Caffey Group in Lease Payments Case

PPGMR Law recently obtained a dismissal for firm client The Caffey Group, LLC (“TCG”) in a lease compensation case in the Circuit Court of Van Buren County, Arkansas. PPGMR Law attorneys Scott Morgan and Patrick Feilke successfully achieved dismissal of all claims in a case involving the payment of rental and bonus compensation under an oil and gas lease, including claims of mutual mistake, unjust enrichment, and lack of consideration. 

Plaintiff’s causes of action were based on compensation due to them under their oil and gas leases with TCG.  Plaintiffs alleged that, because of a mutual mistake in certain underlying Lease Purchase Reports and Ownership Reports, TCG failed to pay all lease rental and bonus compensation due to Plaintiffs under their oil and gas leases with TCG. Plaintiffs requested that the Court reform said Lease Purchase Report and the Ownership Reports.  The Court previously entered an order dismissing with prejudice all of Plaintiffs’ claims which arose out of the exact leasing transaction and involved the same parties and facts as the current suit, except for Plaintiffs’ mutual mistake claim, which was dismissed without prejudice.  As such, the Court held that Plaintiffs’ claims of unjust enrichment and lack of consideration, having previously been dismissed, were barred by res judicata.  The Circuit Court also rejected Plaintiffs’ mutual mistake argument and found that the Plaintiffs failed to plead sufficient facts upon which relief can be granted, as the substantive law of Arkansas does not provide for the relief sought by Plaintiffs.
