Supreme Court Stays Clean Power Plan

The Supreme Court of the United States today stayed implementation of the federal Clean Power Plan while the United States Court of Appeals for the District of Columbia Circuit hears arguments on the Plan's legality.  The Clean Power Plan is a cornerstone of the Obama administration's environmental policy and would drastically impact electricity generators by limiting carbon dioxide emissions per kilowatt hour, among other initiatives.  Arkansas is one of twenty-nine states currently challenging the Plan, which officially began on December 22, 2015.  

Under the stay, electricity generators will not need to begin transitioning their energy sources to comply with the regulations until a final ruling is issued in the case.  The District of Columbia Circuit hears arguments on the Plan on August 2, 2016.  Justices Breyer, Ginsburg, Sotomayor, and Kagan did not join in the Court's decision.
